Digitalists processing of your personal data

Digitalist Open Tech AB processes personal data relating to you in your capacity as a contact person, customer, representative of another organization, or job applicant. This privacy policy describes how and why Digitalist processes personal data, what types of data are processed, what rights you have as a data subject, and what responsibilities we have.

What personal data do we process?

We process personal data such as your name, email address, telephone number, as well as information about the company you work for and your professional role. The personal data is provided by you when a relationship is initiated in various ways, for example when you fill in our contact form, apply for a job, act as a partner or subcontractor following a phone call, or otherwise come into contact with Digitalist, as well as in connection with quotations or events.

Data Controller

Why do we process your personal data?

Before a customer relationship or other relationship is established, we process your personal data in your role as a contact person, job applicant, or partner/subcontractor. You are not obliged to provide your personal data, but it may be required if you wish to use our services, apply for a job with us, or become a partner/subcontractor.

If you are a customer, we process your personal data in order to provide the services you have ordered and to otherwise fulfill our obligations to you. This includes contacting you regarding matters related to the services you use, as well as invoicing and follow-up.

If you are a partner/subcontractor or a job applicant, we process your personal data in order to administer our cooperation and fulfill our commitments.

Digitalist also processes your personal data in order to provide information and marketing that we believe may be of interest to you and your organization. If you do not wish to receive direct marketing, we will cease this upon your request. The easiest way to opt out of marketing communications is to use the unsubscribe link included in each message.

Legal basis for the processing of personal data

The processing of your personal data is based on a balancing of interests. Marketing may be conducted via email, telephone, and postal mail. In this assessment, Digitalist’s legitimate interest in providing information and marketing about our services and in contacting potential customers has been weighed against what we know or can reasonably assume about your interests, as well as your fundamental rights and freedoms regarding personal privacy.

Based on this assessment, we have concluded that Digitalist may justify the processing of your personal data on the basis of legitimate interest, as your interests, rights, and freedoms do not outweigh the need for such processing. In particular, we have considered that you represent an organization that has shown interest in our services (where applicable), and that as an organizational representative, you can reasonably expect that your publicly available or business-related contact details may be used by service providers and other companies.

If you are a customer, Digitalist processes your personal data in order to fulfill the agreement with you, including providing the services you have ordered, and to fulfill the rights and obligations arising from the agreement between Digitalist and the company you represent. In this case, processing is based on the necessity of performing a contract to which you are a party. Where your name appears on invoices or other accounting documents, your personal data is processed for this purpose in accordance with accounting law obligations.

How long do we store personal data?

Personal data processed for the purpose of fulfilling an agreement with the company you represent is processed for the duration of the agreement or until you are replaced as contact person or authorized signatory. Thereafter, processing for this purpose ceases.

After the termination of a customer or partner/subcontractor relationship, Digitalist continues to process personal data that appears in our accounting records, as we are required under accounting regulations to retain such material for up to eight years after the end of the financial year. This legal obligation requires us to continue processing personal data for this purpose.

Digitalist may process your personal data for information and marketing purposes for up to two years after your most recent contact with us. After this period, processing for marketing purposes ceases. You may opt out at any time via the unsubscribe link in each communication.

If you have participated in an event or training organized by Digitalist, or if you have applied for a job with us, we retain personal data for up to three years. After this period, processing for this purpose ceases.

Recipients of personal data

Digitalist shares your personal data with IT service providers and providers of support services in finance and marketing that we engage in order to deliver our services. In such cases, Digitalist has entered into data processing agreements with the external parties that process personal data on our behalf.

Your rights

You have the right to access the personal data we process about you by requesting a register extract. You also have the right to request rectification (correction of inaccurate data), erasure (deletion of data that no longer needs to be processed), restriction of processing, and data portability (to receive your data in a structured, commonly used, machine-readable format for transfer to another controller).
